ผู้ต้องกักขัง หมายถึง ผู้ที่ถูกกักขังตามหมายกักขังของศาล แบ่งเป็น 2 ประเภท คือ ๑ ศาลสั่งลงโทษจำคุกไม่เกิน 3 เดือน ฐานความผิดลหุโทษเปลี่ยนเป็นโทษกักขังแทนโทษจำคุก หลังจากถูกพิพากษาให้ชำระค่าปรับ ประมวลกฎหมายอาญาวางหลักว่า หากไม่ชำระค่าปรับภายใน 30 วันจะต้องถูกกักขังแทนค่าปรับ ซึ่งจากการสอบถามกลุ่มผู้ต้องขังพบว่าถูกสั่งกักขังทันทีโดยไม่มีการรอให้ครบ 30 วันตามที่  มาตรา ๓ ในพระราชบัญญัตินี ผู้ต้องกักขัง หมายความว่า ผู้ทีถูกกักขังตามหมายกักขังของศาล กักขังไปกักขังไว้ทีอืนได้ทัน ท่วงทีจะปล่อยผู้ต้องกักขังไปชัวคราวก็ได้ แต่ผู้ต้อง  6 พ ค 2568 กักขัง หมายถึง บังคับให้บุคคลอยู่ในที่จำกัด เช่น การขังไว้ในห้องปิด ล้อคประตู ไม่สามารถออกทางอื่นใดได้ หรือแม้ออกได้แต่หากออกไปจะเป็นอันตรายก็อยู่ในความหมายของการกักขังเช่นกัน หลังจากถูกพิพากษาให้ชำระค่าปรับ ประมวลกฎหมายอาญาวางหลักว่า หากไม่ชำระค่าปรับภายใน 30 วันจะต้องถูกกักขังแทนค่าปรับ ซึ่งจากการสอบถามกลุ่มผู้ต้องขังพบว่าถูกสั่งกักขังทันทีโดยไม่มีการรอให้ครบ 30 วันตามที่
